1. Scope and Application
This Policy applies to personal information we collect in the course of commercial activities related to the Service. It does not apply to third-party websites, platforms, or services that you access independently, including social networks, game clients, or payment portals governed by their own privacy statements. By using the Service, you acknowledge the practices described in this Policy. If you do not agree, you must discontinue use.
2. Regulatory Framework
Our handling of personal information is subject to the Personal Information Protection and Electronic Documents Act (Canada) ("PIPEDA"), which establishes fair information principles for private-sector organizations engaged in commercial activities. Where we send commercial electronic messages, we comply with Canada's Anti-Spam Legislation ("CASL"). We may also be subject to other federal statutes of general application in Canada where relevant to our operations. Nothing in this Policy is intended to limit rights afforded to you under mandatory law.
Cross-border processing. Personal information collected through the Service may be processed or accessed outside Canada by service providers, infrastructure partners, or integrated platforms. Under PIPEDA's accountability principle, we take reasonable steps to ensure that personal information transferred for processing remains protected by contractual or comparable safeguards appropriate to the sensitivity of the information. Specific technical architectures are not described in this public Policy.
3. What Is Personal Information
For purposes of this Policy, "personal information" means information about an identifiable individual, as defined under PIPEDA. It does not include business contact information used solely to communicate in a commercial capacity, or information that has been irreversibly anonymized and cannot reasonably be linked to an individual.
4. Categories of Information We Collect
Depending on how you interact with the Service, we may collect categories of information including, without limitation:
- Account and identity information - information you provide to register, authenticate, or manage your profile;
- Subscription and transaction information - billing status, plan entitlements, and records necessary to fulfill commercial obligations (payment card details are handled by payment processors, not stored by us in full form where industry-standard tokenization applies);
- Operational and technical information - signals generated by your use of dashboards, overlays, APIs, companion tools, and connectivity features;
- Interaction and audience-derived information - data arising from live-stream integrations, including identifiers, display names, engagement metrics, and event metadata made available through connected platforms;
- Communications - correspondence you send to support channels; and
- Security and integrity information - information used to detect abuse, enforce terms, and protect the Service.
We do not publish exhaustive inventories of fields, schemas, retention periods, or storage locations in this Policy. Collection is limited, where practicable, to what is reasonably necessary for identified purposes.
5. How Information Is Collected
Personal information is collected directly from you (for example, when you create an Account or contact us), automatically through your use of the Service, and from Third-Party Platforms you choose to connect, subject to their APIs and your authorizations. We may also receive information from service providers acting on our instructions. You are responsible for the accuracy of information you supply and for permissions you grant to third-party integrations.
6. Purposes of Collection, Use, and Disclosure
We collect, use, and disclose personal information for purposes that a reasonable person would consider appropriate in the circumstances, including to:
- provide, operate, maintain, and secure the Service;
- authenticate Users and administer Accounts and Subscriptions;
- facilitate live-stream integrations and configured in-game or on-stream effects;
- process payments and manage billing disputes;
- communicate service-related notices, security alerts, and support responses;
- send commercial electronic messages where consent or implied consent exists under CASL, with unsubscribe mechanisms;
- analyze aggregate or de-identified trends to improve reliability and features;
- detect, investigate, and prevent fraud, abuse, or violations of our Terms; and
- comply with legal obligations and respond to lawful requests from authorities.
We will not use personal information for materially new purposes without providing notice and, where required, obtaining additional consent.
7. Consent and PIPEDA Fair Information Principles
PIPEDA requires accountability, identifying purposes, consent, limiting collection, limiting use, disclosure and retention, accuracy, safeguards, openness, individual access, and challenging compliance. We seek meaningful consent, express or implied depending on sensitivity and context, before or at the time of collection where required. You may withdraw consent subject to legal or contractual restrictions; withdrawal may impair Service functionality. Implied consent may apply where you voluntarily provide information for obvious purposes, or where reasonable expectations support continued use after notice.
8. Disclosure to Third Parties
We may disclose personal information to:
- processors and contractors bound by confidentiality and data-protection obligations;
- payment, hosting, analytics, communications, and security vendors;
- connected platforms when necessary to perform integrations you enable;
- professional advisers under privilege; and
- law enforcement or regulators when required by valid legal process.
We do not sell personal information. We do not disclose personal information to unrelated third parties for their independent marketing without consent. Where personal information may be disclosed outside Canada, we implement measures consistent with PIPEDA and our accountability obligations, which may include contractual protections and access controls.
9. Safeguards
We maintain administrative, technical, and organizational measures appropriate to the sensitivity of the information and the nature of our operations. No method of transmission or electronic storage is completely secure; we cannot guarantee absolute security. You are responsible for safeguarding credentials, API keys, and private overlay links associated with your Account.
10. Retention
We retain personal information only as long as necessary to fulfill the purposes for which it was collected, to meet legal and contractual requirements, and to resolve disputes or enforce agreements. Retention schedules may vary by category and operational need. When information is no longer required, we take steps designed to delete, anonymize, or securely dispose of it, subject to backup and archival constraints.
11. Accuracy
We rely on you to provide accurate Account information and to keep it current. You may request correction of personal information that is inaccurate or incomplete, subject to verification. Certain data elements originating from Third-Party Platforms can only be updated at the source platform.
12. Your Rights and Access Requests
Subject to limited exceptions under PIPEDA, you have the right to request access to personal information we hold about you and to request correction. We will respond within timeframes prescribed by applicable law, typically within thirty (30) days, and may extend where permitted with notice. We may require sufficient detail to confirm identity and to locate records. Access may be denied where permitted by law, including where disclosure would reveal confidential commercial information of another party, threaten security, or is frivolous or vexatious.
13. Challenging Compliance
If you believe we have not handled your personal information in accordance with this Policy or applicable law, contact us first at tiktokbo2@shibalabs.live. We will investigate complaints in good faith. You may also lodge a complaint with the Office of the Privacy Commissioner of Canada regarding matters governed by PIPEDA: www.priv.gc.ca. We encourage you to contact us before escalating so we may address concerns directly.
14. Commercial Electronic Messages (CASL)
We send emails or messages that may constitute commercial electronic messages only where we have consent or a permitted exemption under CASL. Each message includes identification of the sender and an unsubscribe mechanism. You may withdraw consent to marketing communications without affecting transactional or security notices necessary to provide the Service.
15. Cookies and Similar Technologies
We use cookies, local storage, and comparable technologies to maintain sessions, remember preferences, protect against automated abuse, and measure Service performance. You may control certain technologies through browser settings; disabling them may limit functionality. We do not describe individual cookie names or durations in this Policy.
16. Children
The Service is not intended for individuals below the age of majority in their jurisdiction. We do not knowingly collect personal information from minors without appropriate authority. If you believe a minor has provided information without consent, contact us to request deletion where legally permissible.
17. Third-Party Links and Platforms
Integrations with external platforms are governed by their privacy policies. We are not responsible for their practices. When you connect a live account, you authorize the exchange of information necessary for the integration to function; you may disconnect integrations through available controls, subject to residual data handled under this Policy and our retention practices.
18. Business Transfers
If the Operator sells, reorganizes, or transfers the Service or related assets, personal information may be transferred to a successor subject to confidentiality and continued protection consistent with this Policy, with notice where required by law.
19. Changes to This Policy
We may update this Policy to reflect legal, technical, or operational changes. The "Last updated" date will be revised accordingly. Material changes will be communicated through the Service or by email where appropriate. Continued use after the effective date constitutes acknowledgment of the revised Policy, except where further consent is required.
